The French luxury house Hermès is widely known for its exclusivity, so much so that shoppers often purchase multiple products just to have a chance to buy their coveted bags. However, two Californians recently filed a class action suit against the brand in light of this practice. According to the complainants, despite spending "tens and thousands of dollars" at the boutique, they were still unable to purchase the coveted Birkin bags.

Californian residents Tina Cavalleri and Mark Glinoga claim that Hermès' buy-for-buy purchasing practice for its handbags violates California's antitrust law.

California's antitrust law addresses anticompetitive practices, including business collusion, illegal monopolization, and anticompetitive mergers. According to the lawsuit, Tina Cavalleri, a loyal Hermès client, was informed in September 2022 that she couldn't purchase another Birkin bag because it was reserved for "clients who have been consistent in supporting our business."

Similarly, Mark Glinoga, who also sought the bag in question, was repeatedly told he needed to purchase other items and accessories first. The plaintiffs argue that Hermès' practice of requiring clients to build a "sufficient purchase history" by buying ancillary products from different style categories effectively increases the price and profits of Birkin handbags.
